Caprica is able to consider providing litigation financing for a large spectrum of litigation or arbitration cases.

The following non exhaustive list provides some indication of the types of cases we consider:

  • General Commercial Disputes
    Securities litigation, breach of contract, agency disputes, shareholder disputes, warranty claims, misrepresentation claims and breach of trust are just a few of the commercial dispute areas that Caprica can consider.
  • Group/Class Litigation (non-injury)
    Whether a claim in mass torts, group investor claims or cartel claims being pursued by multiple claimants (plaintiffs), the team at Caprica are skilled in structuring viable funding arrangements for the benefit of the group.
  • International Arbitrations

    Caprica is able to consider most forms of international arbitrations including cases being pursued through the International Centre for Settlement of Investment Disputes (ICSID), UNCITRAL Rules, International Chamber of Commerce (ICC) and the London Court of Arbitration (LCIA).
  • Competition/Antitrust Litigation
    We regularly receive litigation financing requests from claimants (plaintiffs) who have suffered from anti-competitive behaviour both in respect of direct and indirect purchasers. We can consider providing litigation financing where there is a mass group claim or alternatively isolated claims for clients who have opted out of group litigation in favour of pursuing their own competition/antitrust claim.
  • Securities Litigation
    Caprica can consider most forms of securities and corporate litigation, including mergers and acquisition disputes, breaches of fiduciary duty, indemnity and warranty claims, investor claims, shareholder disputes and various types of securities group/class actions.
  • Professional Negligence Disputes
    We regularly consider proposals for litigation funding for professional negligence cases. These can range from small value disputes between SMEs and contractors through to large value complex claims by investors and companies against professionals such as lawyers, auditors and other financial advisors.
  • Pensions Litigation

    Caprica understands that the risks and costs consequences associated with legal proceedings are of particular concern within the pension litigation arena, particularly if the client is a trustee whose main aim is to protect the underlying fund assets.We can provide cost effective litigation funding to assist those clients to pursue recoveries without risking the pension fund assets or triggering the trustees’ personal liability.
